Overview of the TPD

The Tobacco Products Directive (TPD), enacted by the European Union, governs the sale and marketing of tobacco and related products across its member states. It aims to safeguard public health by setting stringent regulations.

Effective since 20 May 2016, the TPD covers cigarettes, roll-your-own tobacco, and electronic cigarettes, implementing measures such as packaging standards, advertising restrictions, smoke-free environments, taxation, and anti-illegal trade activities.

Key Regulations under the TPD

Specifically addressing e-cigarettes, the TPD mandates:

  • Minimum safety and quality standards for e-cigarettes and e-liquids
  • Clear consumer information to enable informed choices
  • Protection of minors from accessing these products
  • Prohibition of medicinal claims about vaping

Effective from May 2017, TPD rules for nicotine-containing vaping products include:

  • Limiting e-liquid volume per container to 10 ml
  • Restricting e-cigarette tank capacity to 2 ml
  • Capping nicotine strength in e-liquids at 20 mg/ml
  • Mandating child-resistant and tamper-evident packaging
  • Banning additives like caffeine, taurine and colourings
  • Requirement for MHRA submission before sale
  • Inclusion of appropriate warnings and information
  • Prohibition of medicinal claims in marketing

Disposable Vape Ban from 1 June 2025

From 1 June 2025, it will be illegal for businesses to sell, supply or possess for sale any single-use or “disposable” vapes in the UK, including both nicotine and non-nicotine devices. This measure is intended to tackle environmental litter (over a million disposables are discarded daily) and reduce under-age vaping.

Reusable and refillable devices remain legal to sell and supply, ensuring adult smokers continue to have access to safer alternatives.

How This Impacts You

  • Retailers must clear all disposable vape stock by 31 May 2025 or face penalties.
  • Consumers can still use existing disposables but will not be able to purchase new ones after 1 June 2025.
  • Refillable and rechargeable devices are encouraged as sustainable alternatives.
